Mizanly Terms of Service

1. Agreement, product and operator

Mizanly is a personal finance management and money-intelligence application developed and published by ZarMasTech. In these Terms, “Mizanly,” “ZarMasTech,” “we,” “us” and “our” refer to the Mizanly product and its developer/publisher as applicable. “You” means the person using Mizanly.

These Terms apply to the Mizanly app, related Mizanly web pages on zarmastech.com, and Mizanly services that link to these Terms. Additional terms from Google Play, Google, or another service provider may also apply when you use their services.

2. Eligibility and personal use

Mizanly is intended for adults. By using Mizanly, you represent that you have the legal capacity to agree to these Terms. If applicable law requires a higher age or additional consent for particular services, you must satisfy those requirements.

Mizanly is currently intended for personal finance organization and ordinary consumer use. You may not represent that ZarMasTech has authorized you to resell, white-label, sublicense, commercially distribute or operate Mizanly for third parties unless ZarMasTech has expressly agreed in writing.

3. Mizanly's purpose and no professional advice

Mizanly provides tools that allow users to record, organize, review and better understand personal financial information. Features may include account tracking, income and expense recording, transfers, budgets, savings goals, loan tracking, recurring activity, reports, planning tools, reminders, financial scores, forecasts and other informational features.

Calculations, reports, recommendations, projections, Safe-to-Spend information, Money Score information, financial insights, reminders and similar features are provided for informational and organizational purposes only. They are not professional financial, investment, credit, tax, accounting or legal advice.

You should independently evaluate important financial decisions and seek advice from an appropriately qualified professional where relevant. Do not rely on Mizanly as the sole basis for a transaction, borrowing decision, investment, tax filing, legal position or other material financial action.

4. Your financial information and decisions

You are responsible for the accuracy, completeness and timeliness of information you enter, import or maintain in Mizanly. Calculations and insights can only be as accurate as the information and assumptions available to the app.

Balances, forecasts, currency conversions, reports, reminders, notifications, budgets, projections and similar outputs may be delayed, incomplete, estimated or affected by device settings, software limitations, user input, third-party services or network availability.

If you use Mizanly to record loans, repayments or arrangements with another person, Mizanly is only a record-keeping tool. ZarMasTech is not a party to those arrangements and does not determine their legality, enforceability, interest, repayment obligations or tax treatment.

5. Account and device security

You are responsible for maintaining control of your Mizanly account, device, email account, passwords, PINs, biometric access and other credentials used with the service. You are responsible for activity performed through your account except to the extent applicable law provides otherwise.

Use reasonable security measures, keep your device software updated and do not share passwords or one-time authentication codes. If you believe your account or device has been compromised, promptly secure your credentials and contact Mizanly support.

6. Limited licence to use Mizanly

Subject to these Terms and applicable law, ZarMasTech grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use Mizanly on supported devices for its intended personal-finance purposes.

This licence does not transfer ownership of Mizanly or any intellectual-property right to you. All rights not expressly granted are reserved by ZarMasTech and its licensors.

7. Intellectual property and ownership

Your financial records, notes, receipt images and other content you create or provide remain yours or subject to whatever rights you otherwise hold in them. You grant ZarMasTech only the permissions reasonably necessary to process that content to operate Mizanly, provide requested features, secure the service, comply with law and perform actions described in the Privacy Policy.

These Terms do not claim ownership of general ideas, financial concepts or methods that the law does not protect. They protect Mizanly's original expression, software implementation, branding, content and other legally protectable materials.

8. Acceptable use and prohibited conduct

You agree not to, and not to assist others to:

• Access or attempt to access another user's account, records or non-public Mizanly systems without authorization.
• Interfere with, disrupt, overload, damage or bypass the security, authentication, App Check, purchase-verification, access-control or anti-abuse mechanisms of Mizanly.
• Circumvent Mizanly Pro, subscription, lifetime-purchase, advertising or entitlement controls.
• Reverse engineer, decompile, disassemble, derive source code from, modify or create derivative works from Mizanly except to the limited extent such restriction is prohibited by applicable law.
• Scrape, crawl, probe, scan or conduct unauthorized automated or security testing against Mizanly infrastructure.
• Copy, clone, reproduce, redistribute, resell or commercially exploit Mizanly's software, original interface, branding, documentation or protected content without authorization.
• Use Mizanly to violate law, infringe another person's rights, facilitate fraud, abuse systems, distribute malicious code or misrepresent your identity or affiliation.
• Use another person's purchase, entitlement or credentials in a manner not permitted by Google Play, ZarMasTech or applicable law.

Nothing in this section prevents lawful interoperability, security research or other activity that applicable law expressly permits despite contractual restriction. If you believe you have found a security issue, contact support@zarmastech.com rather than testing production systems beyond what is authorized.

9. Mizanly Free and Mizanly Pro

Mizanly may offer a Free version supported by advertising and one or more paid Mizanly Pro products. Available Pro features, prices, billing periods and purchase options may vary by platform, country, account, promotion or product version.

Mizanly Pro may include monthly subscriptions, annual subscriptions and/or a one-time “lifetime” purchase where offered. A lifetime purchase means a non-recurring Mizanly Pro entitlement for the supported lifetime of the applicable Mizanly consumer service and eligible account, subject to applicable law and continued availability of the service. It is not a promise that any software, platform, company, device ecosystem or online service will operate forever.

Mizanly Pro entitlements may be associated with the Mizanly account that initiated or successfully restored the purchase. Permanently deleting that Mizanly account may affect the ability to associate an existing purchase with a newly created Mizanly account, subject to the purchase system, product implementation and applicable law.

10. Billing, renewals, cancellation and refunds

Purchases made through Google Play are processed by Google Play and are also subject to Google's applicable billing, subscription, cancellation and refund rules. Where a subscription automatically renews, the applicable purchase screen and Google Play account controls govern renewal and cancellation.

You are responsible for reviewing the price, billing period and renewal information presented before purchase. You can manage or cancel eligible Google Play subscriptions through Google Play's subscription controls. Cancelling a subscription generally affects future renewal; access for a paid period and refund eligibility depend on Google Play's rules, applicable law and the circumstances of the purchase.

Deleting your Mizanly account does not itself cancel a Google Play subscription or automatically create a refund. If you no longer want future subscription charges, cancel the subscription through Google Play as well as taking any separate Mizanly account action you want.

Nothing in these Terms limits refund, withdrawal, cancellation or other purchase rights that applicable law gives you and does not allow to be waived.

11. Advertising

Eligible Free users may see advertisements supplied through Google AdMob. Advertising availability, personalization, measurement and privacy choices may depend on region, consent choices, device settings, account state, applicable law and Google's services.

ZarMasTech does not guarantee that advertising will always be available, relevant, error-free or suitable for you. An advertisement is content supplied by an advertiser or advertising platform and, unless expressly stated otherwise, is not an endorsement by ZarMasTech of the advertiser, product or service.

12. Backups, exports and data preservation

Mizanly may provide local, exported or Google Drive backup and restore features as convenience tools. You are responsible for checking important backups and maintaining additional copies of information where appropriate.

No backup, export, storage, synchronization or restore system can be guaranteed to operate without interruption, corruption, incompatibility or data loss. Do not rely on a single copy of information that is important to you.

Google Drive backups are stored through your own Google authorization and may remain in your Drive app-data area until removed through supported controls or your Google account. ZarMasTech does not guarantee indefinite compatibility with every old backup format, although reasonable efforts may be made to maintain or migrate supported data.

13. Third-party services

Mizanly may rely on or integrate with third-party services including Google Firebase, Google Cloud, Google Drive, Google Play, Google AdMob, Google ML Kit and device-platform services. Those providers operate under their own terms, privacy policies, availability and technical requirements.

ZarMasTech does not control third-party networks, stores, account systems or services and is not responsible for outages, account restrictions, policy changes or failures caused solely by those third parties, except where applicable law requires otherwise.

14. Service availability, updates and changes

Mizanly may change, improve, add, remove, suspend or discontinue features for technical, security, legal, product or business reasons. Updates may be necessary to maintain compatibility, security or access to certain functionality.

Reasonable efforts may be made to maintain reliability, but continuous, uninterrupted or error-free availability is not guaranteed. Features can vary by device, operating system, country, account type, app version, service-provider availability and applicable law.

If an important paid feature is materially changed, ZarMasTech will handle the change in accordance with applicable law and relevant store requirements.

15. Closed testing, beta and preview features

From time to time Mizanly may make testing, preview, experimental or early-access functionality available to selected users. Such functionality may be incomplete, change more frequently or contain defects. Unless otherwise stated, it is provided for evaluation and feedback and should not be relied on for critical financial decisions.

Participation in testing does not give a tester ownership of Mizanly, its source code, future features or confidential materials that may be expressly identified as confidential.

16. Privacy

Your use of Mizanly is also governed by the Mizanly Privacy Policy, which explains how Mizanly accesses, processes, stores, shares, protects, retains and deletes information and how privacy choices work.

17. Account suspension, deletion and termination

You may stop using Mizanly at any time. Supported financial-data deletion and permanent account-deletion options are described in the app and on the Account & Data Deletion page.

ZarMasTech may restrict or suspend access where reasonably necessary to address security threats, fraud, abusive conduct, legal obligations, material violations of these Terms or risks to other users or systems. Where reasonable and legally permitted, proportionate steps will be used and access may be restored when the underlying issue is resolved.

Permanent Mizanly account deletion does not automatically cancel or refund purchases managed independently by Google Play. Certain provisions that by their nature should survive termination — including intellectual-property protections, disclaimers, liability provisions, dispute terms and payment obligations already incurred — continue to apply.

18. Disclaimers

To the maximum extent permitted by applicable law, Mizanly and related services are provided on an “as is” and “as available” basis. ZarMasTech does not warrant that every calculation, balance, forecast, reminder, notification, exchange-rate display, report, OCR result, backup, restore, advertisement, financial insight or third-party integration will always be accurate, complete, current, uninterrupted, secure or error-free.

No oral or written statement creates a warranty unless expressly stated as such by ZarMasTech or required by law. This section does not exclude warranties, guarantees or statutory protections that cannot lawfully be excluded.

19. Limitation of liability

To the maximum extent permitted by applicable law, ZarMasTech will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, opportunity, goodwill or data, arising from or related to Mizanly where such damages may lawfully be excluded.

You remain responsible for your financial decisions and for independently verifying important information before acting on it. ZarMasTech is not responsible for losses caused by inaccurate user-entered data, decisions made solely from informational app outputs, failure to maintain reasonable backups, compromised user credentials, unsupported devices, or failures of third-party services outside ZarMasTech's reasonable control, except where applicable law provides otherwise.

Where applicable law permits a monetary cap on liability, ZarMasTech's aggregate liability arising out of or relating to Mizanly will not exceed the greater of (a) the amount you paid directly for Mizanly during the 12 months before the event giving rise to the claim or (b) the equivalent of USD 50. This cap does not apply where such a limitation is prohibited, including any liability that cannot lawfully be limited for fraud, wilful misconduct, or other non-excludable responsibility.

20. Responsibility for unlawful or abusive misuse

To the extent permitted by applicable law, if your unlawful, fraudulent or unauthorized misuse of Mizanly causes a third-party claim against ZarMasTech, you agree to be responsible for losses, liabilities, costs and reasonable expenses arising directly from that misuse. This provision does not require a consumer to indemnify ZarMasTech for ZarMasTech's own wrongdoing or for liability that applicable law places on ZarMasTech.

21. Consumer rights and non-waivable protections

Nothing in these Terms is intended to exclude, restrict or waive a right, remedy, guarantee or protection that applicable consumer, privacy or other law says cannot be excluded or waived. If a provision conflicts with a mandatory law that applies to you, the mandatory law controls to the extent of the conflict.

22. Governing law and disputes

These Terms are intended to be governed by the laws of Pakistan, without regard to conflict-of-laws principles, except to the extent mandatory law in your country or region gives you protections that cannot be displaced by this choice.

Before starting formal proceedings, you and ZarMasTech are encouraged to try to resolve a dispute in good faith by contacting support@zarmastech.com with enough information to understand the issue. If a dispute cannot be resolved informally, it may be brought before a court of competent jurisdiction in Karachi, Sindh, Pakistan, unless applicable law gives you a mandatory right to bring the matter elsewhere.

23. Feedback and suggestions

If you voluntarily send ZarMasTech ideas, suggestions, feature requests or other feedback about Mizanly, you understand that ZarMasTech may already be developing similar ideas. To the extent legally necessary for ZarMasTech to use your voluntary feedback, you grant ZarMasTech a worldwide, perpetual, irrevocable, royalty-free right to use, adapt and incorporate that feedback without compensation or obligation to you.

This feedback provision does not transfer ownership of your financial records, private account data, receipt images or other personal content merely because you use Mizanly.

24. Changes to these Terms

These Terms may be updated when Mizanly's services, business model, legal requirements, security practices or product functionality change. The latest version will be published at this URL with an updated revision date.

If a change materially affects your rights or obligations and applicable law requires additional notice or consent, ZarMasTech will use an appropriate notice or consent method. Continuing to use Mizanly after an effective update may constitute acceptance where permitted by law.
